MIDNIGHTLY

Privacy Policy

Last updated 18 October 2026.

In short: Midnightly has no account, no analytics, no advertising and no tracking. Your travel record, documents and household information stay on your iPhone, or in your own iCloud account if you turn on iCloud backup. We do not run servers that receive them, so we cannot see them.

Who is responsible

Midnightly is published by ELAQ Limited, a company registered in Ireland ("we"), which is responsible for this policy. Questions about privacy: privacy@midnightly.app.

What the app processes, and where

All of the following is processed and stored only on your device, in the app's private storage. It is shared only with the app's own widgets, through an App Group on the same device.

  • Location, if you allow it. The app uses low-power location changes and visits, not continuous GPS, to work out which country you are in each day and when you cross a border. Your record keeps the country for each day, not a trail of where you went.
  • Photos and Calendar, only if you choose to connect them. The app reads dates and locations on the device to suggest days you have not recorded. It never changes your photos or events, and it does not copy them.
  • Days, trips and rules you enter or import, including CSV files you choose to open.
  • Documents and evidence you add to the Vault, such as passport and visa details, expiry dates and attachments.
  • Household members you add, their days and the consent log.
  • Questions to Ask Midnightly. Answers come from the rules engine on your device. Where Apple Intelligence is available, the wording runs on Apple's on-device model. Questions are not sent to us or to any AI service.
  • Face ID, if you turn on app lock. This is handled by iOS. The app only learns whether you passed.

What we collect

Nothing. The app has no account, no analytics or crash-reporting SDKs, no advertising identifiers and no third-party tracking. In App Store terms: Data Not Collected.

When data leaves your device

  • When you export or share. CSV files, PDF evidence reports and household packs leave the device only when you share them, to the place you choose.
  • Purchases. These are handled by Apple. We receive no payment details. The app checks your purchases with Apple's StoreKit.
  • Links you tap. Links to official sources and to this website open in Safari.
  • iCloud backup, if you turn it on. In Settings you can choose to back up your record to your own iCloud account, so you can restore it on a new iPhone. The copy is stored in Apple's iCloud under your Apple Account and Apple's terms; we have no access to it. Attachments are not included. It is off unless you turn it on.
  • Device backups. If you back up your iPhone to iCloud or a computer, iOS may include the app's data in that backup under Apple's terms.
  • Verifying a report. The page at midnightly.app/verify checks a report's signature in your browser. The report is not uploaded.

If you email us

If you contact support, we receive your email address and what you send. We use it only to reply, keep it no longer than needed to deal with your request, and never sell it.

This website

midnightly.app is a static site with no analytics, advertising or tracking cookies. Our hosting provider may keep standard server logs, such as IP address and time of request, for security.

Children

Midnightly is not directed at children. A parent can add a child to a household on their own device. That information stays on the parent's device.

Your rights

Because your data is on your device, you control it directly. You can see it in the app, export it, change it, or delete it by clearing the data in Settings or deleting the app. If privacy laws such as the UK or EU GDPR or the CCPA give you rights over data we hold, such as an email you sent us, contact us and we will respond within the time the law requires.

Changes

If this policy changes, we will post the new version here with a new date. If a change ever involved collecting data, we would say so in the app before it happened.
